Heard learned counsel for the petitioner.
Present petition has been filed with a prayer that the court below be directed to decide Execution Case No. 72 of 2004 (Rajendra Kumar Agrawal vs. Mohd. Roshan and another) within stipulated period.
Submission is that the execution case is pending since 2004 without any effective process.
Hon'ble Apex Court has repeatedly observed that there should be speedy disposal of the execution proceedings.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the court below to expedite the hearing of the aforesaid case and decide the same, in accordance with law, expeditiously, preferably within a period of nine months from the date of production of certified copy of this order before him provided there is no other legal impediment.
With the aforesaid observations/ directions, the present petition is finally disposed of.
