Heard Mr. S.D. Yadav, Advocate, holding brief of Mr. Anil Kumar Ray, learned counsel for the applicants and the learned A.G.A. for the State.
This application under section 482 Cr. P. C. has been filed challenging the entire proceedings of Complaint Case No. 11001 of 2018 (Smt. Gulnaj Bano Vs. Mohd. Kamil and others), under section 12 of the Protection of Women From Domestic Violence Act, 2005, P.S. Babupurwa, District Kanpur Nagar, pending in the Court of Special Chief Judicial Magistrate, Kanpur Nagar.
A notice can be challenged only on limited grounds i.e. the Court, which has issued the notice, had no jurisdiction to entertain the complaint, the compliant itself was not maintainable. None of the aforesaid grounds are found to be existent in the present case.
In view of the above, no case for interference is made out.
Consequently, the present application fails and is, accordingly, dismissed.
