Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed seeking direction to the Chief Judicial Magistrate to prosecute Paras Jain in pursuance of FIR dated 03.03.2015 and to expedite trial of Case Crime No. 164 of 2015, under Section- 409 I.P.C., Police Station- Khatauli, District- Muzaffar Nagar.
Learned counsel for the applicant submits that the applicant is the first informant in case crime no. 164 of 2015 under Section 409 IPC. He further submits that the allegation made by the applicant against the opposite party no. 4 are serious with respect to official records.
Considering the fact that the trial has remained pending since 2015 and without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, without granting any unnecessary or long adjournments to either of the parties, as expeditiously as possible, if there is no other legal impediment.
