The petitioners herein are defendants nos.2 to 5 in the Original suit No.597 of 2002 (Om Prakash Vs. Radha Raman) wherein a written statement has been filed on their behalf on 26.03.2015.
Submission of the petitioners herein that they are the owner in possession of the suit property and on account of the pendency of the suit for specific performance of an agreement to sell allegedly executed by the then vendor, they are not able to use their property to its fullest.
Be that as it may, having perused the order sheet, without expressing any opinion on the merits of the claim of the parties, the present petition is disposed of with the direction to the court of Civil Judge, (S.D.), Mathura to proceed with the Original Suit no.597 of 2002 ( Om Prakash Vs. Radha Raman), expeditiously and make an endeavour to decide the same preferably within a period of eight months from the date of submission of certified copy of this order without granting any unnecessary adjournment to any of the parties.
It is made clear that in case of any such adjournment, it would be open for the court below to impose appropriate cost upon the parties seeking adjournment.
