JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 21387 of 2001 Petitioner :- Mohan Lal Respondent :- State Of U.P. And Others Counsel for Petitioner :- R.N. Yadav,Onkar Nath Counsel for Respondent :- C.S.C.,B.D.Panday
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared on behalf of petitioner.
2. By means of the present writ petition, petitioner has sought the following reliefs:
"(i) issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 11/12.4.2001 (Annexure No. 1 to writ petition) passed by respondent no. 3.
(ii) issue, a writ, order or direction in the nature of mandamus commanding the respondents to reinstate the petitioner at the post of Cycle Keeper/cum Peon in the University of Gorakhpur and be further pleased to direct the respondents to give regular salary month by month when fall due without any delay.
(iii) issue, a writ, order or direction in the nature of mandamus commanding the respondents to ensure the payment of Cheque No. 313408 dated 26.2.1999 of Rs. 24,500/- issued by the petitioner with immediate effect and remaining Rs. 24,000/- including back wages for period of 1.10.1998 to 17.11.1999 within a specified period for which the petitioner had worked. (Annexure No. 5 to the writ petition).
(iv) issue, a writ, order or direction in the nature of mandamus commanding the respondents to regularise the services of the petitioner and pay the salary of forth class employee."
3. However, I have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
