The instant writ petition has been filed praying for the following reliefs:-
"I. Issue a writ, order or direction in the nature of mandamus commanding/directing the Respondent No.3 to permit the petitioner to appear for L.L.B. 3rd Year Examination 2018, alongwith L.L.B. 1st Year Re-Examination 2017 in any subject, or provide 2 marks as grace-marks in the L.L.B. 1st Year Re- Examination 2017, so the petitioner may be declare pass in the L.L.B. 1st Year Examination.
II. Issue a writ, order or direction in the nature of mandamus commanding/directing the Respondent No.3 to permit to the petitioner for appear in the L.L.B. 3rd Year Examination 2018."
Sri Vivek Verma, learned counsel appearing on behalf of the respondent University, on instructions, states that the petitioner could not clear one paper of L.L.B. first year examination so far and, therefore, he would not be entitled to appear in L.L.B. third year examination.
On the other hand, learned counsel for the petitioner submitted that the petitioner having passed second year examination, he is entitled to appear in the third year examination.
Having regard to the nature of the controversy, this Court feels that interest of justice would be served in permitting the petitioner to approach the third respondent, so that he may examine the facts of the case and take appropriate decision in accordance with law.
Accordingly, the instant writ petition is disposed of with liberty to the petitioner to approach the third respondent with a certified copy of this order and a fresh representation within one week from today and in which event, the third respondent shall decide the same by means of a speaking order within next three weeks.
