JUDGMENT / ORDER

Rule.
MR.Maulik Nanavati, learned Additional Public Prosecutor waives service of Rule for the respondent-State.
The instant application is filed seeking temporary bail for the period of 60 days in connection with FIR being I- C.R. No.343/2011 registered with Sayaji Ganj Police Station, District:Baroda regarding the offences punishable under Section 302 of the Indian Penal Code etc. Ms.
Patel learned advocate for the applicant submitted that father of the applicant is sick and he is hospitalized since 07.06.2012 and is in very critical condition. It is submitted that earlier in Criminal Misc. Application No.7621/2012 the applicant was released on temporary bail and he surrendered in time.
Heard Mr. Maulik Nanavati, learned APP for the respondent-State.
Having considered the facts and circumstances of the case, so also considering the medical papers annexed with this application, the copy of the order passed by this Court and the fact that in past, he surrendered in time after the completion of period of his temporary bail, the application deserves to be partly allowed.
For the foregoing reasons, the application is partly allowed and the applicant is ordered to be released on temporary bail for the period of two weeks from the date of his actual release on his furnishing personal bond of Rs.10,000/- with one surety of like amount to the satisfaction of concerned Jail authority. On completion of period of temporary bail, he shall surrender before the Jail authority and during the period of his temporary bail, he shall maintain law and order and shall not misuse his liberty.
Application stands disposed of. Rule made absolute accordingly. Direct service is permitted.
