Heard learned counsel for the applicant and learned AGA.
Present application u/s 482 Cr.P.C. has been filed for quashing the charge-sheet dated 18.2.2019 of S.T. No. 155 of 2019 arising out of Case Crime no. 1283 of 2018, u/s 307, 323, 326 IPC, P.S. Kataghar, District Moradabad.
It has been argued that applicant is son-in-law of opposite party no. 2; the matrimonial dispute was going on between the daughter of opposite party no. 2 and applicant on account of which it is stated that the applicant had resorted to firing causing injury to four persons.
Learned AGA opposed and submitted that no case for quashing the F.I.R. is made out and prima facie from the allegation made in the F.I.R. supported by injury report present application is liable to be dismissed.
The application has no force and same is accordingly dismissed.
Learned counsel for the applicant has prayed that the applicant may be permitted to move an application for claiming discharge u/s 227 Cr.P.C..
I may record that right is always available to the accused without any order of the Court.
