Heard Sri Ram Chandra Yadav,learned counsel for the petitioners and learned Standing Counsel for the respondents.
The petitioner has preferred the present writ petition with the following main prayers :-
"(a) Issue a writ, order or direction in the nature of certiorari quashing the consolidation proceeding initiated of present in the Village-Agsada, Mustafabad, Tahsil-Nizamabad, Distirict-Azamgarh.
(b) Issue a writ, order or direction in the nature of mandamus directing the respondent authorities to decide the representation of the petitioner regarding re-valuation of land and demarcation of Plots adjacent to the Canal and Pathway before starting the consolidation proceeding in the Village-Agsgda Mustafabad, Tahsil-Nizamabad, District-Azamgarh within the short stipulated period."
During course of arguments learned counsel for the petitioner states that he does not want to press the prayer (i) and confined his prayer only in respect of prayer (ii).
It is argued by learned counsel for the petitioner that the petitioner filed a representation before the respondent- Consolidation Commissioner on 27.9.2021, copy of the said representation is appended as annexure no. 5 to the writ petition but till date no decision has been taken on the same by him.
Learned Standing counsel submits that no useful purpose would be served to keep the writ petition pending and suitable direction may be issued by this Court to the authority concerned for deciding the same in time bound manner.
Without entering into the merits of the case, the writ petition is disposed of finally directing the respondent no.2/Consolidation Commissioner, Lucknow U.P. to decide the representation of the petitioner dated 27.9.2021 by passing appropriate orders on the same expeditiously and preferably within a period of three months from the date of production of certified copy of this order.
