The petitioner, who is defendant in Original Suit No. 172/2015, has filed the instant petition under Article 227 of the Constitution challenging the decision of the trial Court on issue Nos. 2 & 3 regarding valuation of the suit and sufficiency of court fees.
Admittedly, the suit is pending before the Court of unlimited pecuniary jurisdiction i.e. Civil Judge (Sr.Div.), Moradabad (Judge Small Causes, Moradabad). In such view of the matter, this Court is not inclined to entertain the challenge to the impugned order in exercise of power under Article 227 of the Constitution.
The petition is accordingly dismissed.
