Heard Sri Gyan Prakash Mishra, learned counsel for the applicant and Sri Abhinav Prasad, learned A.G.A. for the State-respondent.
Vide orders dated 7.1.2019 and 21.1.2019 on the request of learned A.G.A. time was granted for filing the counter affidavit but till date no counter affidavit has been filed by the State-respondent.
Learned A.G.A. submits that on 7.1.2019 and 21.1.2019 letters have been sent for compliance of the earlier orders.
In view of the above, Senior Superintendent of Police, Kanpur Nagar is directed to explain as to why counter affidavit has not been filed till date and ensure filing of the same by 18.3.2019, failing which the Senior Superintendent of Police, Kanpur Nagar shall remain present before this Court.
