JUDGMENT / ORDER

This Contempt Petition has been filed alleging disobedience of the order and direction issued to the respondents in W.P.(MD) No.11572 of 2011 dated 04.02.2014 to effect survey of the lands allotted to the petitioners and to hand over possession.
2.The Revenue Divisional Officer, Uthamapalayam filed a counter affidavit, from which it is seen that there is certain difficulty in allotting the said lands on account of a writ petition filed by one Sundararajan in W.P.(MD) No.375 of 2015 and it appears that the lands have been encroached by certain other persons.
3.The learned counsel appearing for the petitioners submitted that if there is any impediment for allotting the said lands, then alternative lands may be allotted. It is stated that in S.No.1794/5 an extent of 18 acres of land is available and suitable for being assigned.
4.Since there is stalemate in the matter, the respondents are directed to examine as to whether the encroachment could be removed within a time frame or in the alternative the petitioners may be offered alternative lands, for which they should be directed to appear before the respondents, for which notice shall be issued by the respondents within a period of three weeks from the date of receipt of a copy of this order.
5.This Contempt Petition is closed with the above directions.
