JUDGMENT / ORDER

This Criminal Original Petition has been filed to direct the Additional Sessions Judge, Namakkal to receive the petition filed under Section 70(2) of Criminal Procedure Code in S.C No.75 of 2014 for recalling Non-Bailable Warrant issued against the petitioner and consider the same.
2. The petitioner filed an application under Section 70(2) of Criminal Procedure Code before the learned Additional Sessions Judge, Namakkal, for R.MAHADEVAN, J., sr recalling the Non-Bailable Warrant, issued against the petitioner, which came to be returned for the purpose of furnishing security,
3. Heard the learned Additional Public Prosecutor and perused the records carefully.
4. The trial Court should have considered the petition, filed under Sec.70(2) of Criminal Procedure Code and pass orders. If the petitioner is directed to furnish security, it is for the petitioner to comply with the order. Under such circumstances, the learned Additional Sessions Judge, Namakkal is directed to consider and pass necessary orders on the petition, filed under Sec.70(2) of Criminal Procedure Code and such exercise shall be completed within a period of two weeks from the date of receipt of a copy of this order.
