(Per : HONOURABLE MR.JUSTICE P.B.MAJMUDAR) The point involved in this matter is as to whether the Area Development Authority can send proposal for extension of time provided by section 9 of the Gujarat Town Planning and Urban Development Act, 1976 retrospectively and whether the Government has power to grant such retrospective extension. In our view, since the matter is admitted, now it is required to be decided finally without delay as because of pendency of this appeal, development work may halt.
With the consent of learned advocates for both the sides, the matter be placed for final hearing on 19.6.2012 just below the admission board.
Civil Application be kept along with the main appeal. Ad-interim relief granted earlier to continue till further orders.
