JUDGMENT / ORDER

1. Rule.
Ms.Chenta Shah, learned Additional Public Prosecutor, wavies service of Rule on behalf of the respondent-State.
2. Heard Ms. J.C. Bhatt, learned advocate for the applicant and Ms.Chetna Shah, learned Additional Government Pleader for the respondent-State.
3. The present application is filed by the under-trial prisoner Mr.Milind Pushpadan Kothari for releasing him on temporary bail on the ground of sickness of his father.
4. Applicant's father Pushpadan Jayantilal Kothari is aged about 62 years and he has to undergo surgery of nephrolithotomy as certified by Dr.Kirit H. Asodiya of Anidip Surgical Hospital, Ahmedabad.
5. The present applicant has preferred an application before the Trial Court on the same ground by way of filing Criminal Misc. Application No.4914 of 2011. By order dated 28.12.2011, the Additional City Sessions Judge, Court No.14, Ahmedabad partly allowed the application and granted temporary bail for one day i.e. for 03.01.2012 from 9:00 hours to 18:00 hours with police escorts consisting of PSI and two Police Constables.
6. The applicant has requested to grant 30 days for temporary bail without any police escorts.
7. I have gone through the certificate issued by Dr.Kirit H. Asodiya as well as order dated 14.02.2011 passed by this Court in Criminal Misc. Application No.1821 of 2011 by which the applicant was granted two weeks temporary bail on the ground of sickness of his mother.
8. Considering the above aspects of the matter, the applicant is ordered to be released on temporary bail for a period of two weeks from the date of his release, on his depositing a sum of Rs.2,000/- with the Jail Authorities. During the aforesaid period, on every Monday of each week, the applicant shall mark his presence before the Odhav Police Station, Ahmedabad. Upon completion of the aforesaid period, the applicant will surrender before the Jail Authorities, forthwith. Rule is made absolute to the aforesaid extent.
