M.Gajanandam vs The Competent Authority And

Madras High Court|07 June, 2017

JUDGMENT / ORDER

There appears to be a dispute between the petitioner and the impleaded respondent. A suit for specific performance has been filed in O.S.No.18 of 2007 on the file of Sub Court, Ponneri, which is still pending trial. Now, the present writ petition is filed seeking dispossession of the compensation amount.
2. Admittedly, as on today, the petitioner is only an agreement holder. The ex-parte decree has been set aside. This Court is of the view that the relief sought for in this writ petition cannot be granted at this stage, as the petitioner, as of now, is only an agreement holder. However, considering the facts and circumstances of the case, a direction is issued to the learned Sub Judge, Ponneri, to dispose of O.S.No.18 of 2007 within a period of six weeks from the date of receipt of a copy of this order. Liberty is given to the petitioner to file an application before the Civil Court seeking appropriate interim relief.
3. The writ petition stands disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
