Heard learned counsel for the petitioner and Sri Manvendra Dixit, learned Standing Counsel appearing for respondent nos. 1,2 and 3.
Notice on behalf of respondent no.4 has been accepted by Sri B.K. Tripathi, learned counsel.
By means of this petition, a direction has been sought to the Sub-Divisional Officer to conclude and decide the proceeding of Case No. T202014360603362, under Section 24 of the U.P. Revenue Code, 2006 which relates to demarcation of petitioner's bhumidhari Plot No. 992 area 0.176 hectare at Village Unchani Kalan, Pargana and Tehsil Madiyahu, District Jaunpur.
Learned Standing Counsel has pointed out that with regard to same plot of land, two writ petitions are pending in this Court being Writ Petition Nos. 43610 of 2008 and 32278 of 1998, in which interim orders have been passed for stay and status quo, which have been referred to in the report at page 37 of the writ petition.
Learned counsel for the petitioner states that he has mentioned this fact in the writ petition also but, he states that the authority concerned has wrongly referred to the aforesaid writ petition of 1998 and 2008 inasmuch as they do not relate to plot of the petitioner.
Be that as it may, once the report of the official has stated that only after decision of the High Court in the aforesaid two writ petitions, demarcation and mutation can take place, no such direction as sought for in this petition can be granted.
This petition is, accordingly, dismissed.
