JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Present applications are preferred by the applicant-convict for temporary bail on the ground that he wants to attend the marriage of his cousin sister's who has no brother in the family.
Pursuant to the earlier order passed by this Court,learned APP, based on the report received by him from the Police Inspector, Shil Police Station, states that marriage is there but the apprehension of law and order is voiced. Under the circumstances, the ground is genuine.
Jail report shows that earlier whenever the convict was released, he has surrendered in time and no untoward incident has been reported. However, keeping in view the fact that applicant has been convicted in two cases under Section 302, appropriate condition deserves to be imposed.
Hence, the applicant be released on temporary bail for 3 days i.e. from 8th February, 2012 to 10th February, 2012 on personal bond of Rs.5,000/- (Rupees Five Thousand Only) and one surety of the like amount with the further direction that on every day, while on temporary bail, he shall mark his presence with the concerned police station of the area and upon the expiry of the period, he shall surrender with the jail authority.
Applications allowed to the aforesaid extent. Rule made absolute.
Direct service is permitted today.
