2. Learned counsel appearing for the respondent has no objection for the same.
3. In view of the submission made by the learned counsel appearing for the appellant and also the endorsement made in the memorandum of grounds in the appeal, the Civil Miscellaneous Appeal stands dismissed as withdrawn and it is open to the appellant to challenge the impugned order before the Original Side of this court, in accordance with law. No costs. Consequently, connected miscellaneous petition is closed.
