Applicant, original-respondent, seeks appointment of any person in place of Shri Akshay H. Mehta, Retired Judge of this Court who was appointed as Sole Arbitrator by this Court by order dated 16.7.2010. It is pointed that the said Arbitrator has shown his inability to conclude the arbitration proceedings and retired from such arbitration.
Learned counsel Shri Pancholi appearing for the opponent, original petitioner has no objection to such order being passed. In fact, parties jointly suggest that Shri M.D.Dave, Retired Judge of City Civil Court, Ahmedabad be now appointed as Sole Arbitrator. Request is accepted. Shri M.D.Dave, shall act as Sole Arbitrator to resolve the dispute between the parties. It is stated that the previous Arbitrator had framed issued from which stage, the new Arbitrator may proceed. Ordered accordingly. This application is disposed of in above terms.
