Meghraj vs State

High Court Of Gujarat|13 March, 2012

JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule.
Mr.Pandya, learned APP wavies service of notice of Rule on behalf of the respondent State.
By way of this application, the applicant - convict has prayed that the period of 29 days, for which he had remained out of jail unauthorizedly, be regularized.
From the jail report, it appears that the applicant - convict was enlarged on temporary bail on 22.5.2011 for a period of two weeks. However, he surrendered before the jail authority only on 3.7.2011, which is late by 29 days. From the jail report, it also transpires that for this late surrender, one furlough is already forfeited. While releasing the applicant - convict on temporary bail vide order dated 20.1.2012 passed in Criminal Misc. Application No.639 of 2012, this Court has already made a reference to that effect.
Under these circumstances, no orders are required to be passed in the present application. The application is disposed of accordingly. Rule is discharged.
