This writ petition has been filed by the petitioner seeking direction to the police authorities to conduct fair, proper and impartial investigation in respect of Crime No.777 of 2020 for the offence under Sections 376, 406, 504, 506 of IPC, P.S. Kotwali Nagar, District Banda.
Case of the petitioner is that on 20.9.2020, she lodged a report against respondent no.5 under Sections 376, 406, 504, 506 of IPC, but till date nothing has been done by the police. Learned counsel submits that respondent no.5 has a checkered criminal history and about 18 criminal cases are registered against him. He submits that respondent no.5 is very influential person and, therefore, police is not taking any action against him. Learned counsel submits that a direction may be issued to the police authorities to investigate the matter fairly and impartially.
State counsel submits that the police authorities are under an obligation to do the investigation fairly, impartially and expeditiously and the same would be done in accordance with law.
The present petition is disposed of, directing the police authorities to conclude the investigation of the said case expeditiously and preferably within a period of two months from the date of production of a copy of this order in accordance with law on the basis of evidence so collected.
It is made clear that we have not expressed any opinion on merits of the case.
