The petitioner has preferred the present writ petition challenging the order dated 28.06.2017 passed by the District Basic Education Officer, Lakhimpur Khiri/respondent No.3 whereby the claim of the petitioner for appointment on compassionate ground was rejected by the aforesaid respondent on the ground that the father of the petitioner died during training period and as such, the appointment on compassionate ground could not be given to the petitioner.
A preliminary objection has been raised by Sri Amit Manohar, learned Addtional Chief Standing Counsel representing respondent Nos. 1, 2 and 4 that the petitioner is challenging the order passed in the month of July, 2017 without explaining the reasons of delay. It is further contended by Sri Amit Manohar that in the present writ petition, relief is sought against the District Basic Education Officer, Lakhimpur Khiri/respondent No.3 and as such, the writ petition is not maintainable before this Court and the same is liable to be dismissed on the ground of territorial jurisdiction.
After the aforesaid objections are raised by Sri Amit Manohar, learned Addtional Chief Standing Counsel, learned counsel for the petitioner prays for dismissal of the present writ petition as not pressed with liberty to approach Lucknow Bench of this Hon'ble Court.
In view of the aforesaid, the present writ petition is dismissed as not pressed with liberty as prayed.
