1. Present application, under section 5 of the Limitation Act, has been preferred by the applicants herein - heirs and legal representatives of Pankajkumar Kantilal Sheth, Proprietor of original respondent No.3 - Padmavati Rice Mill, to condone the delay caused in preferring the review application to review the judgement and order dtd.25/1/2011 passed in Civil Revision Application No. 764 of 2001.
2. having heard Mr.Hemang Parikh, learned advocate appearing on behalf of the applicants and Mr.R.A. Sejpal, learned advocate appearing on behalf of the respondent No.1 and considering the fact that it is reported that the respondent Nos.2 and 3 have refused to accept the notice of this Court and considering the averments made in the application in support of the prayer to condone the delay, present application is allowed and delay caused in preferring the review application is hereby condoned. Rule is made absolute accordingly. No costs.
