THE HON'BLE MR JUSTICE C.V.NAGARJUNA REDDY WRIT PETITION No.16491 of 2007 ORDER:
This writ petition is filed for a Mandamus to declare the inaction of the respondents in investigating crime No.69 of 2007 of Piduguralla Police Station, Guntur District, as illegal and arbitrary.
The petitioner lodged a report on 18.04.2007 against one Sri Mannem Appi Reddy, son of Pulla Reddy of Piduguralla Village, Guntur District for insulting and abusing him by his caste name. The said report was registered as Crime No.69 of 2007 for the offence under Sections 506 IPC and (3(i)(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the accused. The grievance of the petitioner is that though respondent No.2 registered the crime on 19.04.2007, neither he has commenced the investigation nor taken any action against the accused.
No counter affidavit is filed by the respondents.
At the hearing, neither the learned counsel for the petitioner nor the learned Assistant Government Pleader for Home is able to state as to the present stage of the criminal case.
In view of expiry of nearly 3 years from the filing of the writ petition, it is reasonable to presume that the respondents would have completed the investigation and filed appropriate report. If this has not been done so far, the respondents are directed to file appropriate report before the jurisdictional Magistrate after completing the investigation within a period of four weeks from the date of receipt of a copy of this order.
Subject to the above direction, the writ petition is disposed of.
As a sequel to disposal of the writ petition, WPMP.No.20983 of 2007 filed by the petitioner for interim relief is disposed of as infructuous.
