1. Heard learned counsel for the petitioners.
2. This petition has been filed, praying for a direction to the learned trial court to decide the application for temporary injunction filed along with the Regular Suit for Permanent Injunction filed by the petitioners against the contesting respondent nos.1 to 3.
3. It has been submitted by the learned counsel for the petitioners that initially when the suit was filed, an ad-interim injunction was granted to the petitioners on 4.9.2018, restraining the defendants from carrying out any kind of construction for changing the nature of the land in dispute and interfering in the peaceful possession of the plaintiffs. However, since this was a time bound interim order, it lapsed due to the strike call given in the learned court below by the lawyers.
4. It has been submitted by the learned counsel for the petitioners that the defendants have appeared and filed their objections to the application for temporary injunction moved by the petitioners and the matter is ripe for hearing. On the last date when it was listed before the learned court below, the Presiding Officer was on leave and the next date fixed is 31.1.2020.
5. Let the application for temporary injunction filed by the petitioners be decided at the earliest, say either on the next date of listing of the said case before the learned trial court or within six weeks thereafter.
6. The writ petition stands disposed of.
