Learned advocate for the applicant submits that, in exercise of power under Section 451 of the Code of Criminal Procedure, 1973 about return of muddamal, the learned Magistrate ought not to have directed the applicant to appear before the Investigating Officer and ought to have decided the application on its own merit.
In view of the above, Rule, keeping it open to the Investigating Officer to take immediate steps with regard to investigation of offences registered against the applicant at the earliest and report to this Court on or before 17.2.2012.
