Heard learned counsel for the applicant and Sri P.K. Giri, learned Additional Chief Standing Counsel and perused the affidavit filed in support of this application.
The present contempt application has been filed for punishing the Opposite Party for willful disobedience of the judgment and order dated 21.5.2015 passed by the Writ Court in Writ Petition No. 12448 of 2015 (Matloob Ali vs. State of U.P. and others). The operative portion of the said order is quoted as under:
"We dispose of the writ petition directing the Investigating Officer, respondent no. 2 to take necessary steps and investigate the matter pursuant to the FIR registered by the petitioner.
The Senior Superintendent of Police, Allahabad will also monitor the investigation done by the Investigating Officer."
A copy of the instruction filed today is taken on record. According to which the order of the writ Court has been complied with.
Learned counsel for the applicant is not disputing the same.
In such view of the matter, this Court is of the opinion that the order of the Writ Court has been complied and no further orders are required. Notices issued against the opposite party stands discharged.
Application is consigned to record.
