Heard learned counsel for the petitioner as well as learned A.G.A. for the State-respondents.
By means of the present writ petition, the petitioner has invoked extraordinary jurisdiction of this Court with a prayer to direct respondents to conclude the enquiry having G.D. No.30 of 2017, Police Station Kotwali, Nagar Karvi, District Chitrakoot.
The submission of learned counsel for the petitioner is that the petitioner's father was electrocuted while he was working in the filed on 28.5.2017. The information regarding his death was given to the police which was entered in G.D. No.30 of 2017 at police station Kotwali Nagar Karvi, District Chitrakoot and thereafter the dead body was sent for postmortem and viscera was preserved but no viscera report has been received till today. In the absence of viscera report, the petitioner who is son of the deceased is not able to claim the compensation, hence the respondents- authorities may be directed to conclude the investigation expeditiously in fair and impartial manner within stipulated period.
Learned AGA contended that investigating officer is under bounden duty to carry out fair and impartial investigation.
Considering the facts and circumstances of this case and the gravity of offence, it is hereby directed that in case the petitioner moves a fresh application within two weeks before the Senior Superintendent of Police, Chitrakoot, respondent no.2, who shall look into the matter and shall ensure that proper, effective and fair investigation be carried out and be concluded at the earliest preferably within two months from the date of production of a certified copy of this order.
With the aforesaid direction, the writ petition is disposed of.
