Heard Mr. Gandhi, learned advocate for the petitioner, Ms. Chitaliya, learned AGP, for the respondent No.1 - State and Mr. B.S.Patel, learned Senior Advocate for the respondent No.2.
2. Having regard to the issues involved, impugned order as well as affidavits filed in the petition, it appears that the petition requires consideration. Therefore, belowmentioned order is passed:-
2.1 RULE.
2.2 The interim relief as prayed for cannot be granted, at this stage, otherwise, it would amount to allowing the petition at this stage. Therefore, prayer for interim relief is refused.
2.3 After 30.11.2012, it will be open to the petitioner to make request for hearing of the petition, if the petition is not listed in the cause list for Final Hearing by then.
