JUDGMENT / ORDER

Petitioners moved this application seeking appointment of Arbitrator under section 11 of the Arbitration and Conciliation Act, to resolve the disputes between the parties arising out of deed dated 15th August 2002.
In response to the notice issued, learned advocate Shri Ashish Dagli appeared for the respondent.
It is not in dispute that the above mentioned deed contains an arbitration clause. Counsel for the respondent has not opposed the appointment of Arbitrator to resolve the disputes arising out of the said deed. He, however, stated that all contentions of the respondents be kept open to be raised before the Arbitrator.
In above view of the mater, I request Mr.Justice M.S.Parikh, Retired Judge to act as Sole Arbitrator to resolve the disputes between the parties arising out of the aforesaid deed. Arbitration petition stands disposed of accordingly.
