JUDGMENT / ORDER

1. Though served no one appears for respondent-Pashim Gujarat Vij Company Ltd., Junagadh.
2. The petitioners have prayed to quash and set aside the order passed by learned Principal and Sessions Judge, in Criminal Misc. Application No. 93 of 2011, by which, the request of the petitioners to return the passport came to be rejected.
3. It is submitted that the petitioners have deposited the amount of disputed electricity bill and further they have roots in the society and the petitioners have deposited Rs.10 lakhs pursuant to the order passed in the anticipatory bail by this Court and so is also recorded in para 4 of the order dated 4.3.2011 passed by the learned Principal Sessions Judge, Junagadh impugned in this petition. In addition to above an additional affidavit is filed by petitioner NO.1 reiterating necessity to travel abroad.
4. Considering the above, by imposing suitable conditions, I am inclined to allow this application by ordering release of passports of the petitioners deposited before the competent Court for the offences, for which, they are being tried. Accordingly, the competent Court in which the passports of the petitioners are deposited shall return the passports to the petitioners for a period of three months on submission of a formal application keeping x-copies of the passports with the Court and the petitioners shall also inform there whereabouts and detail of itinerary to the said Court and on return to the country of native shall deposit the passports.
5. Accordingly this application is allowed. Order accordingly.
