Heard Mr. Anil Kumar Savita, learned counsel for the revisionist and the learned A.G.A. for the State.
This Criminal Revision has been filed challenging the order dated 20.07.2018 passed by the Chief Metropolitan Magistrate, Kanpur Nagar in Complaint Case No.51564 of 2017 (Manoj Singh vs. Ashutosh Niranjan and another) whereby the aforesaid complaint case filed by the revisionist has been dismissed.
Admittedly, the recovery proceedings were initiated against Sandhya Singh the wife of the applicant No.1 Manoj Singh. The notice demanding the electricity dues was received by the revisionist Manoj Singh as there is a clear finding recorded to that effect in the impugned order.
The finding recorded in the impugned order that the notice regarding the payment of the electricity dues was received by Manoj Singh has vehemently been disputed by the learned counsel for the revisionist. However, there is nothing on the record to dislodge the said finding. Once the electricity connection is in the name of the wife of the revisionist and revisionist is residing in the same premise in respect of which electricity dues are alleged, the action for recovery of electricity dues which are the tune of more than Rs.26,00000/- (Rs. Twenty six lakhs only) cannot be faulted with.
In view of the above, this Court does not find any good ground for interference in the Criminal Revision. The Revision fails and is, accordingly, dismissed.
