Learned counsel for the petitioner prays for and is granted permission to make necessary corrections in the description of respondent no.4 during the court of the day.
The petitioner herein has applied for getting fresh water connection on 25.01.2021 with regard to the premises namely house No.106/210 situated at Mohalla Gandhi Nagar, Post R.K. Nagar (Ram Krishna-Nagar, Police Station Sisa Thana, Zone No.4, Kanpur District Kanpur Nagar, Uttar Pradesh.
Only prayer in the writ petition is to command the respondent no.4 to take a decision in the matter.
In view of the aforesaid prayer, this Court does not find any reason to keep the matter pending.
The present writ petition is disposed of with the observation that the respondent no.4 i.e. Executive Engineer, Kanpur Nagar Jal Sansthan District Kanpur Nagar shall consider the prayer of the petitioner for grant of water connection in the application dated 25.01.2021 and take an expeditious decision in accordance with law, preferably within a period of two weeks from the date of receipt of a copy of this order.
It is made clear that we have not entered into the merits of the claim of the petitioner, the respondent no.4 shall consider the matter independently in accordance with law. In case of any hindrance by private persons in installation of water connection, it would be open for the respondent no.4 to take assistance of the local police authority.
