Heard Sri Satendra Singh, learned counsel for the petitioner, Sri Sanjay Kumar Srivastav, learned counsel for the respondent no. 4, learned A.G.A. for the respondents-State and perused the record.
This petition for writ under Article 226 of Constitution of India is preferred with a prayer to quash the first information report bearing Case Crime No. 39 of 2018 pending investigation at Police Station Tundla, District Firozabad pertaining to offence punishable under Sections 147, 148, 149, 452, 307, 323, 504, 506 I.P.C. and 3(1)(D), (Dh) SC/ST Act 1989.
While filing the petition for writ, the petitioner has not disclosed that he has moved an application to surrender the court of learned Additional Sessions Judge, Firozabad and the matter is fixed before that court today only. In view of this factual background, we do not find any just reason to interfere in the matter.
The writ petition is dismissed accordingly.
