Heard learned counsel for the petitioner; learned AGA for respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 17th October, 2019 registered as Case Crime No.396 of 2019, under Section 354-A IPC; Section 7/8 of the Protection of Children from Sexual Offences Act, 2012 and Section 3(2) (va) of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (Amendment 2015) at Police Station Shikarpur, District Bulandshahar.
The allegations made in the impugned first information report disclose commission of cognizable offences and it appears that those allegations have been supported by the victim in her statement recorded under Section 164 CrPC.
Under the circumstances, the prayer of the petitioner to quash the first information report cannot be accepted.
In view of the above, the petition is dismissed without prejudice to the right of the petitioners to apply for bail as may be advised.
