Heard learned counsel for the applicant and learned AGA for the State.
This application under Section 482 Cr.P.C. has been filed to direct Additional Sessions Judge, Court No. 6, Jhansi to accept the bail/surety bond of Sachin Jaiswal for applicant.
Learned counsel for the applicant contended that the applicant has been convicted by Magistrate in Case No. 847 of 2018, Crime No. 25 of 1999 (State Vs. Rajendra Kumar), under Sections 498A, 323, 504, 506 IPC, Police Station- Mahila Thana Nawabad, District- Jhansi. Against conviction order, the applicant has preferred Criminal Appeal No. 79 of 2010 (Rajendra Jaiswal and others Vs. State of U.P.). The appeal was dismissed by Additional Sessions Judge, Court No.6, Jhansi. Against the conviction order and dismissal of appeal, applicant has preferred criminal revision before this Court which is pending before this Court and he was enlarged on bail in criminal revision.
Applicant has submitted application before Additional Sessions Judge, Court no.5, Jhansi to change his surety which was rejected by the Additional Sessions Judge, Jhansi on the ground that no record is available in Sessions court. Record has been sent to this Court.
If, applicant Manoj Jaiswal applies for discharge of surety and submission of fresh surety with certified copy of bail order and surety bond, the Magistrate shall decide his application without unnecessary delay.
Accordingly, this application is disposed of.
