Heard Sri Dev Raj Singh, learned counsel for the petitioner and Sri Kaushalendra Nath Singh, learned counsel appearing on behalf of respondent nos.3 and 4.
By this writ petition, the petitioner has come to this Court for issuance of writ of mandamus directing respondent no.3 to consider the representation of the petitioner pending since 15.01.2019 in respect of the interest and penalty over the balance amount of premium of plot no.212, Block-C, Sector- 100, Noida and to decide the same expeditiously.
Learned counsel appearing for respondent nos.3 and 4 has drawn our attention to the order dated 25.05.2018 passed by the Division Bench of this Court in Writ-C No.63566 of 2009 (Manoj Bhati Vs. State of UP & Ors.) and submitted that in the aforesaid case the revised rate of allotment was challenged, and the Division Bench had dismissed the said writ petition. Against the the order dated 25.05.2018 an SLP being SLP No.23480 of 2018 was filed before the Supreme Court which was also dismissed on 11.01.2019 and, therefore, the petitioner has to pay the revised rate of allotment.
Considering the fact that the representation is pending before the learned authority, without expressing any opinion on merits, we direct the authority concerned to decide the representation expeditiously, preferably within a period of three months from the date of filing of the certified copy of this order.
With the aforesaid observation this writ petition is disposed of.
