Heard learned counsel for the applicant.
By means of this contempt application filed under section 12 of the Contempt of Courts Act, 1971 violation and disobedience shown to the order dated 31.7.2018 is complained of.
From the perusal of the record, it transpires that the order of temporary injunction was passed by the trial court while issuing notices to the defendants in the suit. Since, it is an order passed of the temporary injunction by the trial court, it would be appropriate if the applicant moves an application under Order IX Rule 2A to draw necessary proceedings against the defendants for violating the order of temporary injunction.
Accordingly, this contempt application stands disposed of with direction to the applicant to approach the court concerned by moving an application under Order IX Rule 2A within a period of two weeks from today and in the event any such application is filed, the same shall be considered on merits and shall be expeditiously disposed of strictly in accordance with law.
