Heard learned counsel for the applicant and learned AGA.
The present 482 Cr.P.C. application has been filed for quashing the order dated 27.07.2018 passed by the Additional Sessions Judge, Court No.1, Jaunpur in Complaint Case No.51 of 2017, under Sections 419, 420, 467, 468, 471 I.P.C., Police Station Kotwali, District Jaunpur.
Admittedly, there is previous enmity between opposite party No.4 and the applicant. According to version of complaint, opposite party No.2 - Shakuntla Gupta claiming herself to be wife of the complainant, moved an application under Section 156 (3) Cr.P.C. before the Court. Thereafter, the present complaint was filed by the applicant. Occurrence is said to have taken place within District Sitapur and witnesses of complainant belong to District Janpur. Further, according to version of complaint, the complainant never heard about aforesaid Shakuntla Gupta, but it is admitted in his statement under Section 200 Cr.P.C. that Shakuntla Gupta is sister-in-law of opposite party No.4 - Rajnish. Considering the evidence available on record, complaint was dismissed under Section 203 Cr.P.C., against which Criminal Revision No.51 of 2017 (Mannu Lal Vs. State of U.P. and others) was preferred by the applicant. After considering the material placed on record revisional court dismissed the revision vide order dated 27.07.2018.
I do not find any merit in this application warranting interference by this Court.
Application under Section 482 Cr.P.C. is, accordingly, dismissed.
