By means of this writ petition, the petitioner has come to this Court against the order of mutation of the name of Mata Prasad for House No. 69 and 70 situate at Gola Mandi, Qasba Mungra Badshahpur, District Jaunpur.
The petitioner claims that she has filed a suit for permanent injunction being O.S. No. 790 of 2017 which is still pending. However, the Nagar Palika Parishad noticing the fact that the suit is pending has passed an order of mutation holding therein that the mutation would be subject to final decision of the suit.
The petitioner is already pursuing the remedy before the civil court and in case any order is passed during the pendency of the suit, the petitioner has to move an application in that very suit and apply for interim injunction. In writ proceeding, no relief can be granted.
With the aforesaid observations, the writ petition is disposed of.
