JUDGMENT / ORDER

[1] The applicant has preferred this application for grant of furlough leave.
[2] The applicant-prisoner is convicted for the offence punishable under Section 302 of the Indian Penal Code. It appears from the jail record that when the applicant was released in the month of October, 2007 for 15 days on temporary bail, he did not surrender in time and later on he was arrested by the police and late surrender by 709 days. When again he was released on parole in pursuant to the order of this Court in Special Criminal Application No.1672 of 2011 for 14 days to enable him to prefer Appeal before the Apex Court, he surrendered in time. The applicant-prisoner was released on furlough on condition that the applicant-convict shall deposit Rs.50,000/- before the Jail Authority. Thereafter, the applicant made representation before the Jail Authority and Authority has modified the order and reduced the amount from Rs.50,000/- to Rs.25,000/-. To further reduce the said amount, applicant has preferred the present application before this Court.
[3] Considering the fact that when the applicant was released in the month of August, 2011 he surrendered in time and his jail conduct is good, present application is partly allowed. The amount of deposit is hereby reduced to Rs.5,000/- (Rupees Five Thousand Only) from Rs.25,000/-. Other terms and conditions shall remain unaltered as imposed by the Jail Authority.
