JUDGMENT / ORDER

Petitioner challenges the order of learned Chief Judicial Magistrate, Krishnagiri, passed in C.M.P.No.626 of 2014 in M.C.No.31 of 2009 on 19.11.2015.
2. Heard learned counsel for petitioner.
3. Crl.M.P.No.659 of 2017 has been filed seeking condonation of delay of 59 days in preferring the revision.
4. This Court has perused the affidavit filed by petitioner towards explaining the delay of 59 days in preferring the revision. This Court is not satisfied with the explanation afforded by petitioner. This Court also notes that in dismissing the petition, Court below has found that as there was no representation for petitioner, C.M.P.Nos.31 of 2009 and 70 of 2013 filed by petitioner have been dismissed. Thereafter, C.M.P.No.705 of 2013 has been allowed and PW-1 was cross-examined. At such stage, C.M.P.No.626 of 2014 has been filed seeking the very same relief, which has already been decided under orders in C.M.P.No.505 of 2010 dated 12.01.2012. Finding that petitioner, without challenging such order, has filed the present petition seeking the very same relief, Court below has dismissed the petition. This Court finds no error in the order under challenge.
Accordingly, Crl.M.P.No.659 of 2017 is dismissed. In view of the same, Crl.R.C.No.SR.19194 of 2016 is rejected. 09.02.2017 Index: Yes/No Internet: Yes gm To The Chief Judicial Magistrate, Krishnagiri.
