Learned advocate Mr.Shah appearing for the petitioner pointed out from the plaint Paragrapher 3 that all the heirs of Shri Vervabhai Jaimalbhai were mentioned in the suit preferred in respect of ancestral property. Petitioners herein are the proposed parties seeking impleadment who are the heirs of Babubhai Varvabhai, they are not only the proper parties but are necessary parties. He seeks to rely upon the decision in case of Mumbai International Airport Pvt.Ltd. Vs. Regency Convension Centra and Hotels Pvt.Ltd. and Ors; reported in AIR 2010 Pg. 3109 to challenge legality of the order impugned.
