Heard learned counsel for the applicant and learned AGA for the State.` The present 482 Cr.P.C. application has been filed to quash the order dated 6.12.2017 passed in Criminal Revision No. 90 of 2016 arising out of Case Crime No. 111 of 2016, under Sections 420, 468, 471 and 472 IPC, Police Station Kailiya, District Jalaun as well as cognizance dated 29.08.2016 has been taken in Criminal Case No. 525 of 2016, pending in the Court of Addl. Civil Judge (Jr. Div.)/Judicial Magistrate, Konch, Jalaun.
Learned counsel for the applicant claims the issue of his juvenility has not yet been decided in the aforesaid case with respect of which present offence has been alleged. In the present case the applicant has been charged with having submitted a forged mark-sheet/transfer certificate. Learned counsel for the applicant states that he has already been enlarged on bail. Other arguments advanced by learned counsel for the applicant are factual in nature and would require appraisal of evidence, if they were to be accepted.
In view of the above, no interference is warranted, at this stage. The present application is dismissed.
