1. Heard learned counsel for petitioner and learned counsel appearing for respondents, Mr. Satyendra Mukherjee who appears for respondents No. 1 and 2.
2. Learned counsel for petitiioner submits that he was working in M/s. Duncans Industries Limited (Fertilizer Division), Kanpur, now, known as M/s. Kanpur Fertilizer & Cement Limited and was allotted Staff Number as "02166". He retired on 02.04.2010. At the time of his retirement, he was not facing any disciplinary proceedings. Petitioner's service was governed by the provisions of Employees Provident Fund and Misc. Provisions of Act No. 1952 and a provision for pension was made under the Rules after Amendment of the Act under the Employees Pension Scheme, 1995.

It is submitted by learned counsel for petitioner that petitioner is entitled to grant of pension at his full salary of Rs. 17,240/- and with regard to the same he has made a representation to the respondent No. 2. The respondent No. 2, however, has not taken any decision in the matter. A copy of the representation dated 16.08.2018 filed by the petitioner to the respondent No. 2 has been annexed as Annexure - 6 to the writ petition.

Accordingly, without entering into the merits of controversy, this writ petition is disposed of with a direction to the respondent No. 2 to look into the grievance of the petitioner as raised in his representation dated 16.08.2018 and pass appropriate, reasoned and speaking orders thereon within a period of three months from the date a certified copy of this order is produced before the authority concerned.
