Petitioner's husband was a Shiksha Mitra and was assigned election duty during the panchayat elections in 2021. It is asserted that while performing such election duty he contracted covid-19 and has died on 5.5.2021. An application for payment of ex-gratia compensation in terms of Government Order dated 1.6.2021 has been filed, but no decision upon it has yet been taken and hence this writ petition.
Learned counsel for respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate directions may be issued to the concerned District Magistrate, who may decide the claim of the petitioner.
In this view of the matter, without expressing any opinion on the merits of the case, the writ petition is disposed of directing the respondent no.4, District Magistrate, Gorakhpur to consider the pending application of the petitioner for grant of ex gratia payment under the Government Order dated 01.06.2021 and pass appropriate order, as expeditiously as possible, preferably within a period of one month from the date of production of certified copy of this order considering all the aspects of the case, in accordance with law.
