Heard the counsel for the petitioner.
The present writ petition has been filed challenging the order dated 11.11.2020 passed by the Settlement Officer of Consolidation holding that the amendment application filed by the petitioner shall be decided only after decision on the issue regarding the delay in filing the appeal as well as on the maintainability of the appeal.
The observation has been made by the Settlement Officer of Consolidation in the context that there is a delay of almost 51 years in filing the appeal against the order of the Assistant Consolidation Officer passed in proceedings relating to allotment of chaks. The revision filed by the petitioner against the order dated 11.11.2020 was dismissed by the Deputy Director of Consolidation vide his order dated 27.2.2021. The order of the revisional court has also been challenged in the present writ petition.
There is no jurisdictional error in the order passed by the Settlement Officer of Consolidation in the context that the appeal has been filed after almost 51 years of the order of the Assistant Consolidation Officer.
The writ petition is dismissed.
