Heard learned counsel for the petitioner, learned A.G.A for the respondents-State and perused the record.
This petition for writ is preferred for transfer of the investigation pertaining to Case Crime No. 419 of 2017 for the offence under Section 302 IPC at Police Station Erech, District Jhansi.
Learned counsel for the petitioner submitted that the petitioner is supposed to be an accused and he has yet not been arrested. He further stated that the local police will not make the investigation fairly and objectively and therefore, the investigation deserves to the transferred.
We do not find any reason to accede the prayer made in the petition for writ. The investigation cannot be transferred just for flimsy and non-existing grounds. There is no material available on record to interfere in the matter as prayed in this petition.
The petition for writ lacks merit and is, accordingly, dismissed.
