Heard Sri Jai Singh Yadav, learned counsel for the petitioner, Sri Rajesh Kumar, learned Standing Counsel for respondent nos. 1 and 2 and Sri Arun Kumar Srivastava, learned counsel for respondent no. 3.
The petitioner is a fair price shop holder of Gram Sabha Chhachhaira, Block Pawasa, Tehsil Sambha, District Sambhal. It appears that the license of the petitioner has been suspended by Sub Divisional Magistrate, Sambhal, District Sambhal - respondent no. 2 by order dated 26.4.2019. The petitioner has submitted her reply on 8.5.2019 to the respondent no. 2.
Per contra, learned Standing Counsel submits that petitioner has supplied reply on 8.5.2019 and, therefore, sixty days provided in Section 8(8) of The Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016 for concluding the enquiry has not yet expired.
In the present case, the petitioner has submitted a reply very recently on 8.5.2019 and sixty days provided in Section 8(8) of The Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016 for concluding the enquiry has not yet expired, therefore, the prayer sought by the petitioner cannot be granted at this stage.
However, it is expected from the licensing authority- respondent no. 2 to conclude the enquiry within the period prescribed under Section 8(8) of The Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016.
The writ petition is dismissed.
